% 08.05.2018 By the present petition the petitioner seeks parole on the ground that he has to file a Special Leave to Petition. On a notice being issued, a Status Report has been handed over which is taken on record. As per the Status Report appellant along with his brothers Zia Ul Haq and Abdul Karim were convicted for offences punishable under Sections 302/452/34 IPC registered at PS Kalyanpuri. After the appeal filed by the petitioner and co-convicts was dismissed by this Court on 18th July, 2017, he surrendered but one of the co-convicts i.e. Abdul Karim is absconding and the proceedings to declare him Proclaimed Offender are pending before the learned Trial Court. As per the Status Report, family of the petitioner comprising of his W.P.(CRL) 522/2018
wife, five daughters and one son were found residing at G-598, Ram Swaroop Colony, Shahid Nagar, Sahibabad, Ghaziabad, U.P. Considering the fact that the appellant surrendered after the conviction was upheld by this Court and that he has roots in the society as his family was found residing at the address noted above, this court deems it fit to grant parole to the petitioner.
It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM further subject to the condition that for the period of parole, the petitioner would visit PS Kalyanpuri on every Monday at 4.00 P.M. during the period of parole and the petitioner would give the mobile number of his surety and one of his family members which would be kept in active mode so that the petitioner can be contacted during the period of parole, if required. Petition is disposed of.
A copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
