Counsel for the Petitioner submits that, in light of the objection raised by the Respondent regarding the status of the Defence Services Officers' Institute as not being an instrumentality of the State under Article 12 of the Constitution of India, the Petitioner seeks leave to withdraw the present petition, with liberty to avail appropriate remedies in accordance with law before the Labour Court.

Leave and liberty, as prayed for, are granted. It is clarified that this Court has not expressed any opinion on the Petitioner's proposed course of action, which shall be considered on its own merits in accordance with law. 3.
