BAIL APPLN. 116/2018 Though the prayer made therein was for interim bail for certain domestic reasons, the previous application (Bail Appln.1277/2017) was declined by this court keeping in view the gravity of the offences involved in the case arising out of FIR No.373/2014 under Sections 363/302/201/34 IPC, P.S. New Usman Pur wherein the petitioner is facing trial along with co-accused Amit Gupta, alias Monu.

Keeping in view the evidence that has been presented, in the case which is pending before the court of Sessions, the charges have already been found made out and framed.

The prosecution is in the process of Bail Appln.116/2018

It is fairly conceded that prosecution rests its case on evidence that the petitioner was seen in the company of the co-accused, Amit Gupta, under the same roof, shortly after the child had gone missing, mother of the child having visited the place to enquire as to his whereabouts, and that the report of Forensic Science Laboratory affirms presence of DNA of the petitioner in the nail clippings of the deceased child. Having regard to the above facts, no case for bail is made out. The bail petition is dismissed.
