A Criminal Writ Petition under Article 226/227 of the Constitution of India read with Section 482 Cr.P.C has been filed on behalf of the petitioner seeking Directions in FIR No.1097/2022 dated 28.11.2022 registered under Section 279/337 IPC at Police Station Aman Vihar. 2.

The prayer in the present petition has been made that the investigations be handed over to an independent Investigating Agency/Crime Branch for proper investigation to retrieve the CCTV footage from the cameras at Sukhi Nahar Road, Kirari, Delhi, where the incident had happened and to trace the offending vehicle as well as the offender. It is further sought that the compensation be granted to the petitioner, which she would have otherwise been able to obtain under the Motor Vehicle Act. 3.

identity of the offending vehicle could not be ascertained either from the CCTV Camera footages or from the persons present near the scene of crime. It is further asserted that though the Cancellation Report has been submitted, the petitioner/complainant has not been appearing. Whatever are her grievances, can be agitated before the learned M.M. 4.

Learned counsel for the petitioner admits that in the absence of CCTV Camera footages it has become difficult to ascertain the offending vehicle because it was a Hit and Run case.

However, her grievances are only confined to seeking compensation which she is at liberty to apply to Victim Compensation Scheme, DLSA in accordance with law or purse any other remedy available to her under law.
