O R D E R
% 22.03.2018 Learned counsel for the petitioner submits that petitioner had purchased a plot bearing no. C-118, Ganesh Nagar, Pandav Nagar Complex, Delhi- 110092 admeasuring 50 sq. yds. from one Moti Ram on 28th August, 1994 vide GPA, Agreement to sell, Receipt, Will and affidavit and since then he is in possession of the said plot. It is contended that petitioner lost the original documents of the aforesaid property and NCR had been filed in the year 2015. Petitioner is in possession of photocopies of the documents, which have been handed over to Investigating Officer. Sh. Moti Ram has since died. Learned APP, who is assisted by the learned counsel for complainant, submits that complainant, who is brother-in-law of the petitioner, had purchased the aforesaid property in the name of his wife (sister of the petitioner) from Sh. Moti Ram vide documents, that is, GPA, Agreement of sell, Possession letter, Receipt, Affidavit and
registered Will, all dated 28th August,1994. Complainant has also lost all the documents except the Will. Complainant had lodged FIR in this regard. It is contended that petitioner has forged the GPA etc in order to claim ownership of the property in question. During the course of hearing, it is revealed that respondent had filed a suit for possession in the year 2014 in respect of the aforesaid property and the same is pending.
Keeping in mind the totality of facts and circumstances, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Petitioner shall, however, cooperate in the investigation and appear before Investigating Officer as and when he is called upon to do so.
