By way of present application filed under Section 438 Cr.P.C. the applicant seeks anticipatory bail in FIR No. 0024/2024 registered under Sections 380/454 IPC at P.S. Subhash Place, Delhi. 2.
Learned Counsel for the applicant states that she has been falsely implicated in the present matter by her husband and the complainant. It is stated that notice under Section 160 Cr.P.C already stands issued subsequent to which the father of the applicant has joined investigation. applicant feels an apprehension of getting arrested due to the frequent visits of the police officials to the house of the applicant. Counsel for the applicant further states that the applicant is willing to join investigation as and when directed by the Court.

Mr. Sanjay Lau, learned ASC (Crl.) for the State on instructions from Mr. Jitender Meena, DCP states that as per the CCTV footage, the present applicant is not seen riding the scooty. However, as per the footage collected from the other camera, she can be seen at the spot. Further, as per the CDR collected, the location is also found to be near the spot. As per the status report, notice under Section 41A was served upon the applicant however no response was received.

At this stage, Mr. Lau states that the applicant is the resident of the very same area.

Keeping in view the aforesaid facts and circumstances, the interim protection granted to the applicant vide order dated 27.02.2024 is made absolute and it is directed that in the event of arrest, the applicant be released on bail subject to her furnishing a personal bond in the sum of Rs.25,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which she undertakes to keep operational at all times during the pendency of the trial.
(ii) The applicant shall join the investigation as and when, she is asked for.

(iv) In case of change of residential address/contact detail, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO. (v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.
(vi) The applicant shall regularly appear before the trial Court as and when the charge sheet is filed.
