The appearing counsels state that the parties to these two suits were also parties to a proceeding before the Supreme Court and in which the parties were referred to mediation and which has been successful and all disputes between the parties including those subject matter of these two suits CS(OS) 2546/1995 & CS(OS) 2558/2007

also stand settled in terms of the final order dated 17th August, 2016 of the Supreme Court in Civil Appeal Nos8462-8466/2016 arising out of SLP(C) Nos.20958-20962/2008.

A copy of the said order and a copy of the Memorandum of Family (Mediation) Settlement is handed over in the Court and is taken on record in CS(OS) No.2456/1995.

The counsel for the plaintiff in CS(OS) No.2456/1995, in view of aforesaid, withdraws the suit.

None appears for the plaintiff in CS(OS) No.2558/2007. 5.

However there is no reason to disbelieve the counsels. 6.

Accordingly, both suits are dismissed as withdrawn in view of aforesaid, leaving the parties to bear their own costs. RAJIV SAHAI ENDLAW, J.
