The present application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been filed by the applicant seeking extension of interim bail for a further period of 30 days in case arising out of FIR bearing No.491/2015 registered at Police Station, Subzi Mandi, Delhi for the offences punishable under Sections 307/120B/34 of the Indian Penal Code, 1860 ('I.P.C') read with Sections 25/27/54/59 of Arms Act, 1959. 4.

02.02.2024 in B.A No. 4291/2023 and that the applicant is required to surrender before the Jail Authorities on 05.03.2024. It is submitted that the interim bail was granted to the applicant on the ground that applicant's father had to undergo a surgery on 10.02.2024. However, the applicant was released on 14.02.2024 from the jail and therefore, the surgery was cancelled. Learned Counsel for the applicant further submits that the surgery of applicant's father has been rescheduled for 07.03.2024 and in these circumstances, the interim bail granted vide order dated 02.02.2024 be extended for a further period of 30 days as prayed for. 5.
Learned APP appearing on behalf of the State submits that the applicant was released on 14.02.2024 and therefore, his father's surgery had to be postponed as the applicant had failed to take his father to the hospital due to his late release from the prison.

Having gone through the contents of application and having heard arguments addressed by both the parties and also taking into account the fact that the surgery of the father of the applicant is scheduled for 07.03.2024, in these circumstances the applicant is directed to surrender tomorrow i.e. 28.02.2024 before the concerned Jail Superintendent. However, this Court notes that the applicant has earlier remained on interim bail vide order dated 02.02.2024 passed by this Court and has not misused the liberty of interim bail so granted. In view thereof, this Court is inclined to grant interim bail to the applicant for a period of 15 days from date of his release from 05.03.2024 since his father's surgery is rescheduled for 07.03.2024. 7.
Accordingly, on applicant furnishing a bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Trial Court/Successor Court/Link Court/Duty Judge concerned, the applicant shall The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
be released on interim bail for a period of 15 days beginning from 05.03.2024 to 19.03.2024 on the following terms and conditions: (i) The applicant shall remain available on mobile numbers; shared by him with the Police.
(ii) The applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner.
(iii) The applicant shall duly surrender before the concerned Superintendent Jail after the expiry of interim bail. 8.
It is clarified that no further extension of interim bail shall be granted to the applicant.
