O R D E R

The present bail application has been filed seeking regular bail in FIR No. 499/2019 under Sections 307/34 IPC, registered at Police Station Bawana.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he has been in custody since 09.10.2019. He submits that the petitioner's brother's wife had earlier lodged FIR No. 266/2019, under Sections 376/328/506 IPC registered at Police Station Bawana, Delhi against the complainant. He further submits that the co-accused, namely Heena & Praveen have already been admitted to bail. He further submits that on the date of incident the petitioner had lodged a cross FIR against the complainant i.e. FIR No. 500/19 under Sections 308/34 IPC registered at Police Station Bawana, Delhi. He submits that the nature of injuries is opined to be simple. BAIL APPLN. 129/2020

Learned APP for the State, on instructions, confirms that as per medical report, the nature of injuries are opined to be simple. She, on instructions, further submits that the petitioner is not involved in any other case.

In view of the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Trial Court and subject to the following conditions:- (i) The petitioner will not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (ii) The petitioner shall provide the I.O./SHO Police Station Bawana, Delhi with his mobile phone number and in the event of change of his residential address, shall inform the same to the I.O./SHO.

(iii) The petitioner shall not leave the jurisdiction of the National Capital Territory of Delhi without prior permission of the concerned Court.

(iv) The petitioner will remain regularly present before the Trial Court.

With the above directions, the bail application is disposed of. DASTI.
