This Writ Petition has been filed against an interlocutory order dated 27.01.2026, passed by the learned Central Administrative Tribunal (hereafter 'CAT') vide which the interim order, by which interim protection was granted to the Applicant, was vacated. The relevant extract is reproduced as under: - "8. Applicant has failed to make out a strong prima facie case and balance of convenience also does not lie in his favour. So also, applicant has already been protected and shall not be reverted. Hence, there is no irreparable loss likely to be caused. for official respondents submitted that vide OM dated 27.01.2026 issued by respondents not to recover and also not going to revise pension and pensionary benefits in case of the applicant.

For all the reasons stated hereinabove, and in our considered opinion, at this stage, it is a fit case to vacate interim order dated 26.09.2025 as contempt petition is pending in OA/1719/2012, wherein applicant was one of the private respondents and this fact was not brought to the notice of the Tribunal and interim order was passed in ignorance of material facts."

Learned counsel representing the parties admit that there are various connected matters listed before the learned CAT and in most of the matters, arguments have been finally heard and judgment has been reserved. The O.A. filed by the Petitioner is also listed for today. 3.

Keeping in view the aforesaid facts and the stage of the proceedings before the learned CAT, the present Writ Petition, along with the pending applications, is disposed of while requesting the learned CAT to expeditiously dispose of the O.A. filed by the Petitioner, preferable within next two months, uninfluenced by the observations made in the impugned order.
