BAIL APPLN. 127/2020 The matter has been received by transfer on the directions of the Hon'ble The Chief Justice as the Hon'ble Mr. Justice Chander Shekhar is on leave today.
Vide the present application, the applicant has sought the grant of interim bail for a period of 15 days w.e.f. 20.01.2020 to 04.02.2020 to attend the marriage function of his younger brother. Inter alia it has been submitted on behalf of the applicant that vide the order dated 15.01.2020 of the learned Trial Court of the ASJ-04, Central, the prayer that had been made by the applicant qua the BAIL APPLN. 127/2020
marriage of the cousin brother of the applicant fixed for 16.01.2020 and of his own brother fixed for 30.01.2020 was taken into account with custody parole having been granted for six hours each for 16.01.2020 as well as 30.01.2020 on both occasions excluding travelling time to visit and attend such marriage ceremony. It has been submitted on behalf of the petitioner and not refuted on behalf of the State that the stated factum of marriage as scheduled, has been verified. In the circumstances now, in the interest of justice the applicant is allowed to be released on interim bail from the date 25.01.2020 to 31.01.2020 on filing of his bail bond in the sum of Rs.1,00,000/- with two sureties of the like amount to the satisfaction of the learned Trial Court with directions that the applicant shall surrender before the Superintendent Jail, Delhi on the date 31.01.2020 by 4:30 PM.
The order dated 15.01.2020 of the learned Trial Court is modified accordingly.
The application stands disposed of.
Copy of the order be given Dasti, as prayed under the signatures of the Court Master.
