By way of the present petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 [in short, 'Act'], the petitioner seeks appointment of an Arbitrator to adjudicate the disputes between the parties under the purchase order/agreement dated 25.08.2021. The arbitration clause is Clause 7 of the agreement.

Notice was issued in the petition. Dr. Shilpa Vitthal Rao Bagade, learned counsel enters appearance on behalf of the respondent. 3.

She submits that some conciliation proceedings had also taken place between the parties and the claim of the petitioner was settled, however, inadvertently, the present purchase order was not mentioned in those proceedings.

Having regard to the above and with the consent of learned counsels for the parties, the disputes are referred to arbitration under the aegis of Delhi International Arbitration Centre, Shershah Road, Delhi High Court, New Delhi-110003 [in short, 'DIAC'], and will be governed by the rules of DIAC, including as to the remuneration of the learned Arbitrators. 6.

The DIAC is requested to nominate an Arbitrator from its panel. 7.

The learned Arbitrator is requested to furnish declaration under Section 12 of the Act, prior to entering upon the reference. 8.

It is made clear that all rights and contentions of the parties are left open for adjudication by the learned Arbitral Tribunal. 9.

The petition stands disposed of.
