Petitioner seeks bail in case FIR No. 60/2024 of PS North Avenue for offence under Section 190/191(2)(3)/115(2)/109(1)/3(5) BNS. Broadly speaking, allegation against the petitioner is that he exhorted the co-accused to stab the victim, which occurred in the course of minor oral altercation between members of the two groups. Admittedly, it is nobody‟s case that the group to which the petitioner belonged went to the spot premeditated to assault the other group. It is informed by both sides that in the cross FIR, all accused persons have been released on bail. Investigation is complete and charge-sheet has already been filed. The petitioner was arrested on 20.10.2024 and continues to be in custody.
