is petition has been filed assailing order dated 13th February 2026 passed by the Motor Accident Claims Tribunal, Rohini Courts, Delhi ('MACT') in Misc. DJ. No. 242/2026 in relation to part release of amounts which have been deposited by Insurance Company. Before the MACT, a settlement had taken place for Rs.30,00,000/- in favour of the legal heirs of the deceased (petitioners herein). MACT directed the apportionment in the following manner:

i.

Rs.15,00,000/- in favour of Ms. Geeta Devi (widow of the deceased).

ii.

Rs.3,00,000/- to Ms. Dhanuli Devi (mother of the deceased). iii.

Rs.6,00,000/- to Master Mayank (minor son of the deceased).

iv.

It was stated that 90% of the amount would be kept in an annuity to be released to them in a phased manner at Rs.10,000/- each per month, and remaining 10% amount would be released to them immediately. 3.

It is stated by counsel for petitioner that only Rs.1,80,000/- has been released to claimants. However, there is a requirement of about Rs.8,00,000/- to meet the liabilities which they have incurred due to the loans that they have taken from other family members. 4.

Ms. Geeta Devi is present in Court along with son, Master Mayank, and states that she requires the said sum for securing the property in which they have been residing based on payment of a security amount, since she now needs to take care of the minor children. 5.

The security agreement executed on 23rd March 2026 between Smt. Radha Bisht (owner of the property where they are staying) and Ms. Geeta Devi, has also been placed on record.

In view of the above, the impugned order is modified to the extent that Rs.8,00,000/- from the compensation apportioned to Ms. Geeta Devi shall be released. Balance amount shall continue to remain in an interestbearing fixed deposit, to be released as per the directions of MACT. 7.

Said release shall be done within a period of next two weeks in the designated accounts of Ms. Geeta Devi, upon verification. 8.

Accordingly, the petition stands disposed of. 9.

Pending applications are rendered infructuous. 10.
