Petitioners being the husband and in-laws of respondent no. 2 have filed this petition seeking quashing of FIR No. 435/2023 of PS Jagat Puri for offences under Sections 498A/406/34 IPC. All the parties have appeared in person, identified by the Investigating Officer SI Ashok Kumar of PS Ghazipur and also by learned counsel for both sides. 3.
Statements of parties have already been recorded by the Registrar concerned on earlier dates. I have spoken with the parties in Hindi. submitted by the parties that all their disputes now stand settled and the present petitioner no. 1 and respondent no. 2 have resumed matrimony. It is explained by respondent no. 2 that for past one year she has been living in the matrimonial home with petitioners along with her daughter happily, so they want the criminal proceedings to be quashed. 4.
Having interacted with the parties, I am satisfied that it would be in the interest of justice not to push the parties through trial. 5.
Therefore, the petition is allowed and accordingly FIR No. 435/2023 of PS Jagat Puri for offence under Section 498A/406/34 IPC as well as proceedings arising out of the same are quashed.
