CRL.M.C. 238/2020 1.

The present proceedings are instituted seeking quashing of FIR No. 0277/2018, registered under Sections 498-A/406//34 IPC at PS Adarsh Nagar, Delhi, on the ground of compromise having been arrived at between the parties.

Learned APP for the State, on instructions, submits that the chargesheet in the present case has been filed against all the petitioners and respondent No.3/complainant is the only victim in the case.

Learned counsel for the petitioners submits that though petitioner No.1 is present in person, however, petitioners No.2 & 3, who are residents of Surat (Gujarat), could not come to Court today on account of their old age.

Learned counsel for the petitioners submits that with the intervention of common relatives and friends, the matter has been settled between the petitioners and respondent No.3 on 28.11.2019 and a Memorandum of Understanding has been executed in this regard. In terms of the said settlement, respondent No. 3 is now left with no claim or grievance whatsoever against the petitioners.

The petitioner No.1, who is present in person, has been identified by his counsel, whereas respondent No.3/complainant, who is present in Court along with her father, has been identified by the Investigating Officer. 6.

Respondent no. 3, present in person, states that she has entered into the settlement with the petitioners out of her own free will, volition and without any undue force pressure or coercion. She further states that she has no objection in case the present FIR and the consequent proceedings are quashed.

Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

The parties shall remain bound by their statements made in Court today.

In view of the settlement arrived at between the petitioners and respondent no.3, in my view, no fruitful purpose would be served in continuation of the present criminal proceedings. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating

therefrom are hereby quashed.

With the above directions, the petition is disposed of. 11.
