O R D E R

After arguments, counsel for the parties, on instructions from the parties, have agreed that the appeal be disposed of as settled. 2.
The appellants are present in person as also the respondent and who have agreed with the following consent order. (i) The rate of rent and use and occupation charges have been agreed to be paid at Rs.3000/- per month with effect from June 2012. (ii) Appellants have deposited the amounts before the trial court as also the first appellate court, and also the amount pursuant to an order of a learned
Single Judge of this Court dated 7.4.2016. These amounts can be withdrawn by the respondent/plaintiff from the concerned courts alongwith accrued interest thereon if any.
(iii) If there are any arrears for being paid at the rate of Rs.3000/- per month, appellants will ensure that appellants will within three months clear such arrears by making payment through cheque to the respondent and which cheque will be delivered to the respondent or to the counsel for the respondent who is appearing in Court against a duly executed receipt. (iv) Appellants will vacate the suit premises on or before 30.6.2017 and will continue to pay charges at Rs.3000/- per month by the 30th of each month.
(v) Respondent/plaintiff will ensure that there is no disturbance, nuisance, handicap or any difficulty for the appellants and their family members to occupy the suit premises and no disturbance will be caused in the enjoyment of water and electricity in the suit premises. (vi) Both the parties will file affidavits of undertaking in terms of the present order within a period of two weeks from today, and on complying
with the terms of the affidavit of undertaking, appellants are allowed to vacate the suit premises on or before 30.6.2017. 3.
The appeal is disposed of in terms of the present consent order and parties will comply with their affidavits of undertaking which will be filed in this Court.
