The Petitioners' case is that they had applied for the post of Constable in Delhi Police through the recruitment process conducted by the Staff Selection Commission1 and have been debarred from participating in the further examination process. Aggrieved thereby, the Petitioners have approached this Court challenging the action of the SSC in debarring them. 2.
At the outset, the Respondent has raised an objection to the maintainability of the present petition, contending that the grievance raised by the Petitioners arises out of a recruitment process conducted by SSC for the post of Constable in Delhi Police. such recruitment fall within the jurisdiction of the Central Administrative Tribunal2 under the Administrative Tribunals Act, 1985. It is submitted that, in view of the judgment of the Supreme Court in L. Chandra Kumar v. Union of India,3 the Petitioner, having an efficacious alternative remedy before the Tribunal, cannot invoke the writ jurisdiction of this Court. 3.
On this issue, the Division Bench of this Court in Ravinder Kumar & Ors. v. Staff Selection Commission4 and Ashish Chauhan & Ors. v. Staff Selection Commission,5 has taken the view that where the recruitment process conducted by SSC includes posts in Delhi Police, CAT would have jurisdiction to entertain such matters.

Considering the above, the Court is not inclined to entertain the present petition in view of the availability of an alternate efficacious remedy of approaching CAT.

Accordingly, the petition is dismissed with liberty to the Petitioners to take recourse to appropriate remedies in accordance with law before the Central Administrative Tribunal. The pending application(s), if any, also stand disposed of.
