By way of the present Petition, the Petitioner prays for issuance of direction to reinstate it in the project and release its payment, representing 40% share.

The Petitioner and Respondent No.2 (M/s Yongma Engineering Co. Ltd.) entered into an agreement and appear to have jointly applied for award of consultancy work, pursuant to a tender issued by the National Highways & Infrastructure Development Corporation Limited. The work was awarded in favour of the Petitioner and the Respondent No.2.

The Petitioner claims that it was removed from the WhatsApp group of the project in the year 2022. submits that he is not being paid payment equivalent to 40% share by the Respondent No.1, though TDS (Tax Deducted at Source) is being deducted and he is not being allowed to participate in the project. 4.

As per the agreement between the Petitioner and the Respondent No.2, the dispute between the parties is to be resolved through Arbitration.

After having heard learned counsel representing the parties, the real dispute appears to be between the Petitioner and the Respondent No.2. The dispute as per the agreement between the parties, is referable to Arbitration.

Hence, this Court does not find it appropriate to entertain the present Writ Petition. Accordingly, the Petition, along with pending application, stands dismissed.
