This writ petition is preferred on behalf of Petitioner under Article 226 of Constitution of India seeking the following relief: "(a) issue a writ of Mandamus or any other writ or relief of like nature thereby directing the respondents to sanction New Electricity connection in the name of Petitioner and to provide the electricity in property bearing No. House No. G- 64 (105), Street No.20-22, Rajapuri Colony, Uttam Nagar, New Delhi-110059 in portion of petitioner." 2.

Learned counsel for Respondents appearing on advance copy of the writ petition takes an objection to the maintainability of this writ petition on the ground that Petitioner has an alternate statutory remedy under Section 42(5) of the Electricity Act, 2003 and thereafter to file appeal before the Ombudsman under Section 42(6) in case of any further grievance. Learned counsel for the Petitioner, on instructions, seeks to withdraw this writ petition to avail the appropriate statutory remedies with regard to a new electricity connection in his name. Without prejudice, it is submitted that Petitioner has been waiting for the electricity connection for the last six months and while he is repeatedly informed that some requisite documents have not been furnished but till date there is no intimation as to what further documents are required to be given and therefore, a direction be given to the Respondents to at least intimate as to what documents are required to be furnished to process his application.

Without entering into the merits of the case, this writ petition is disposed of as withdrawn with liberty to the Petitioner to take recourse to appropriate statutory remedies under the Electricity Act, 2003. It is, however, directed that Respondents shall inform the Petitioner of the documents required to be furnished by him, if any, for the purpose of processing his application for a new electricity connection. This intimation will be given in writing within a period of two weeks from today. 5.

Pending application stands disposed of.
