Petitioner impugns order dated 18.08.2017 whereby the leave to defend application of the petitioner was dismissed and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioner from a shop measuring 7 feet x 8 feet situated on the ground floor of property bearing No.11/53B, Tilak Nagar, New Delhi, more particularly as shown in red colour in the site plan annexed to the eviction petition.

By order dated 23.02.2018 execution of the impugned order was stayed. By order dated 19.03.2019, petitioner was directed to pay use and occupation charges at the rate of Rs.6000/- per month and it was directed that in case there was any default in payment of use and occupation charges, the eviction shall entail forthwith. RC.REV. 36/2018

Learned counsel for the respondent informs that use and occupation charges were not paid and consequently the execution was proceeded with and on 03.10.2019, the possession was recovered through the bailiff, appointed in the Execution Petition. Learned counsel further informs that by order dated 11.10.2019, Rent Controller has recorded the satisfaction of the decree and has disposed of the execution petition.

None appears for the petitioner.

Petition is dismissed for non-prosecution.
