Allowed, subject to all just exceptions. Application is disposed of. CM (M) 45/2020 & CM APPL. 1961/2020 (stay) 2.

Both the counsels appearing for the parties submit that the matter was substantially heard before a Judicial Officer, who has since been transferred and the Court has been abolished. Accordingly, the prayer in the present petition was for listing the matter before the same ADJ, who had heard the matter earlier finally.

Considering the notification dated 24th December 2019 vide which the said Judicial Officer has now been posted as Judge-in-Charge, Mediation Centre, the relief prayed for in this petition cannot be granted. 4.

However, since this is a suit for 1978, it is directed that the Court,

before whom the matter is currently listed, shall hear the arguments and dispose of the suit expeditiously on or before 31st May, 2020. 4.

The petition along with pending application is disposed of with these observations.
