This is a petition under Section 29A of the Arbitration & Conciliation Act, 1996 on behalf of the Petitioner seeking extension of mandate of the learned Arbitrator for making the arbitral award. 2.
Material on record indicates that disputes arose between the parties under a Lease Deed dated 05.11.2019 and this Court vide Order dated 29.03.2023 in ARB.P. No. 354/2023 appointed an Arbitrator to adjudicate the disputes between the parties.

The learned Arbitrator entered into reference on 20.05.2023. Pleadings are complete. Issues have been framed. 4.
It is stated that the period of one year came to an end and the Petitioner filed O.M.P.(MISC.)(COMM) 134/2025 seeking extension of mandate of the Arbitrator and this Court vide Order dated 18.08.2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. extended the mandate of the Arbitrator by six months. It is stated that since the mandate of the learned Arbitrator came to an end on 18.02.2026, the Petitioner has approached this Court by filing the present petition seeking extension of mandate.

Notice was issued in the matter on 16.03.2026. Despite notice, there is no appearance on behalf of the Respondent.

It is the case of the Petitioner that the Petitioner's evidence is being recorded. Since substantial time and money has been spent in arbitration proceedings, this Court is inclined to extend the mandate of the learned Arbitrator till 31.01.2027. The learned Arbitrator is requested to complete the examination of witnesses and also conclude the counter claim within the extended period. Further, the period from 18.02.2026 till today is regularized in terms of the Judgment passed by the Apex Court in Rohan Builders (India) Private Limited v. Berger Paints India Limited, 2024 SCC OnLine SC 2494.
