O R D E R
% 27.03.2026 By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim bail for a period of 120 days in case FIR No.903/2023 dated 31.12.2023 registered under sections 452/323/341/34 of the Indian Penal Code, 1860 ('IPC') at P.S.: Sangam Vihar, Delhi on medical grounds. Though the chargesheet in the matter is not on record, from the nominal roll received from jail, it is seen that the offence under section 302 of the IPC has also been added subsequently. Status report dated 24.03.2026 has been filed in the matter. 3.
Medical Status Report dated 23.03.2026 and Nominal Roll dated 23.03.2026 have been received from the jail.

Learned counsel appearing for the petitioner has drawn attention to Medical Status Report dated 20.02.2026 received from the Chief Medical Officer In-charge, Central Jail No.4, Tihar, New Delhi which narrates, that the petitioner is suffering from multiple ailments and has been under treatment at various hospitals including, Safdarjung Hospital and DDU Hospital.

Since it has not been possible to bring the petitioner's medical ailments in control at the jail medical facilities, it is pointed-out that in the concluding paragraph of medical status report dated 20.02.2026, the jail doctors have said this:
"At present inmate patient is suffering and reporting at jail dispensary to seek medical assistance for newly diagnosed Hypertension with persistent headache/Migraine with sudden blackout (pending non traumatic neurological diagnosis with prescribed MRI Brain/ reporting increased frequency of acute headache with blurring of vision during each episodes), palpitation (under treatment from Safdarjung Hospital and scheduled for 2DEcho, Holter test), intermittent nose bleeding with Left Sided Deviated Nasal Septum (in case of persistent symptomatology patient may be considered for surgical correction of DNS/Septoplasty), right flank pain with burning micturition (under evaluation for renal stone), Lower & upper Back Ache, Neck Pain with morning stiffness (MRI cervical spine with whole spine screening is due) and PR bleeding due to Hemorrhoids for which he is currently on conservative management with possible surgical intervention in future in sight."

Counsel submits, that in view of the above, the petitioner be granted some respite to have himself treated at a private medical facility of his choice.

Mr. Shoaib Haider, learned APP appearing for the State submits, that considering the multiplicity of aliments that the petitioner is believed to be suffering from, the State leaves it to the court to pass appropriate orders.

Learned counsel for the next-of-kin of the deceased is also present and has been heard briefly. She disputes that the petitioner is suffering from the ailments that have been cited as the ground for interim bail. However, this court is persuaded to accept what has been narrated in medical status report dated 20.02.2026 received from the jail doctors. 9.
The petitioner's nominal roll shows that he has suffered judicial custody of more than 02 years as an undertrial; his overall jail conduct has been 'good'; and he has no other criminal involvements. 10.
The medical status report referred-to above clearly shows that the petitioner is suffering from multiple ailments; and it is not unjustified for him to seek consultation/treatment at a private medical facility of his choice.

On a conspectus of the foregoing, and in view of the grounds cited for interim bail, this court is persuaded to allow the present petition, thereby granting to the petitioner-Pankaj @ Narender s/o Amar Pal Singh - interim bail for a period of 06 weeks from the date of his release, subject to the following conditions: 11.1. The petitioner shall furnish a personal bond in the sum of Rs. 25,000/- (Rs. the like amount from family members, to the satisfaction of the Jail Superintendent;
11.2. The petitioner shall confine himself to the National Capital Region of Delhi and the State of Haryana and shall not leave the said two States without prior permission of this court; and shall ordinarily reside at the address as per prison records/as mentioned in the petition;
11.3. The petitioner shall furnish to the I.O./S.H.O.P.S.: Sangam Vihar, Delhi a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;
11.4. If the petitioner has a passport, he shall surrender the same to the Jail Superintendent and shall not travel out of the country without prior permission of this court;
11.5. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; and 11.6. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

Furthermore, at the time of his surrender, the petitioner shall furnish to the Jail Superintendent his medical records in relation to the advice/treatment/procedures that he may have undergone while on interim bail.

Nothing in this order shall be construed as an expression of opinion on the merits of the pending matter.

A copy of this order be sent to the concerned Jail Superintendent forthwith.
