W.P.(CRL) 162/2018 Petitioner is seeking parole for the reason that his niece (sister's daughter) is to be married out on 27.01.2018. The fact that the marriage of the niece of the petitioner is fixed for the said date has been verified by the State. It is factually correct. On 20.12.2017 the application seeking parole had been rejected by the Competent Authority on the ground that in terms of the para 11.1 of the Parole/Furlough Guidelines, 2010 a convict must have served at least one year in prison excluding any period covered by remissions before he could be considered for parole; the convict on the aforenoted date

(20.12.2017) had served only 10 months and 4 days of incarceration. Admittedly, as on date since almost one more month has passed the petitioner has completed incarceration of 11 months plus. The reason mentioned in the petition also having been verified and found to be correct. This Court is of the view that the prayer made in the petition needs to be allowed. The petitioner is granted parole for a period of three weeks (to be counted from the date of his release) on his furnishing personal bond in the sum of ₹10,000/- with one surety of like amount to the satisfaction of the Jail Superintendant concerned with condition that he will forthwith surrender after the expiry of the period of parole; he shall also furnish his latest residential address and mobile number to the concerned SHO; he shall also report on every Monday of each week to the concerned SHO.

Petition disposed of.

A copy of this order be sent to the Jail Superintendant concerned for intimation to the petitioner.
