Learned counsel for the petitioner submits that an application under Section 25(b)(4) of Delhi Rent Control Act is pending disposal. However, instead of disposing of the application, the learned ARC has kept the matter for hearing arguments on the maintainability of the petition whereas his application under Section 25 (b)(4) of DRC Act should be heard first. 2.

It is submitted on behalf of the respondent that he is no longer in the possession of the suit property which has been handed over to one Smt. Minakshi Gupta and the said submission, he had made before the learned ARC, therefore, the matter was kept for hearing arguments on his maintainability.

After addressing some arguments, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the learned ARC with all the submissions as made before this Court by way of present petition.
