The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the petitioner for seeking parole for a period of three months. Status report not filed.

Nominal Roll dated 06.01.2018 reveals that the petitioner was convicted under Sections 302/34 IPC and was sentenced to undergo RI for life imprisonment with fine ` 5,000/-. Crl.A.536/2010 was dismissed by this Court on 24.05.2013. Nominal Roll further reveals that the petitioner has already undergone eight years, six months and ten days incarceration besides remission for one year, three months and twenty-two days as on 03.01.2018. It further reveals that his overall jail conduct is satisfactory. Earlier he was granted parole and there are no allegations of its misuse.

In the interest of justice and for the reasons mentioned in the writ petition, the petitioner is granted three weeks parole from the date of his release, on his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate. After completion of parole period, the petitioner shall surrender before the Jail Superintendent. 4.
