O R D E R

% 06.02.2020 Vide the present petition, petitioner seeks bail in FIR No. 126/17 dated 10.04.2017, registered at Police Station Alipur for the offences punishable u/s 304/323/341/34 IPC.

It is not in dispute that charges against the petitioner has been framed for the offences punishable under section 304/304/323/341/34 IPC on 09.10.2017 and the accused has already been languishing in custody nearly about 2 1⁄2 years. Further, 12 witnesses out of total 19 witnesses have already been examined till today.

It is also not in dispute that co-accused in the present case has also been granted bail by this Court vide order dated 31.07.2018. In view of above, I hereby direct the Trial Court to admit the petitioner on bail on his furnishing personal bond in the sum of ₹15,000/- with one surety of the like amount to its satisfaction.

Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case. The present bail application is allowed and disposed of accordingly.

Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.
