MASTER MOHD HARIS QURESHI (MINOR) THROUGH HIS FATHER ..... Petitioner Through Mr.Alamgir, Advocate.

versus DELHI PUBLIC SCHOOL & ORS ..... Respondent Through Mr.Satyakam, Advocate, for R 2 &3.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 17.01.2018 C.M. No.1818/2018 Allowed, subject to all just exceptions.

The application stands disposed of.

W.P.(C) 424/2018 Vide the present writ petition, the petitioner who is a student of Class-I in the respondent no.1/school has prayed for quashing of the order dated 30.12.2017, vide which his admission has been cancelled by the School on the ground that the income and caste certificates produced by the petitioner's father had been found to be forged. Mr.Satyakam, learned counsel who appears for respondent no.2 and 3 on advance notice, submits that the new caste and income certificates dated 04.07.2015 produced by the petitioner have been verified by the Tehsildar of the concerned District, who, after duly

verifying the authenticity of the said certificates, has issued attested copies thereof under his signatures and has also uploaded the said information on the website of e-District,Delhi. He submits that in view of the fresh certificates having been verified as authentic by the concerned Tehsildar, it would be appropriate that the petitioner approaches the respondent no.1/school with the fresh certificates as his admission had been cancelled by the School only because the said fresh certificates had not been updated on the website of e-District, Delhi. In view of the aforesaid statement made by learned counsel for respondent no. 1 & 2, the learned counsel for the petitioner seeks liberty to withdraw the petition and approach the school with the duly authenticated copies of the certificates handed over to him by the learned counsel for respondent no.2 & 3 in Court.

It is hoped that in case the petitioner approaches the School with a representation alongwtih the fresh certificates, the school will take appropriate and corrective steps to re-admit the petitioner. If the petitioner is still aggrieved by the decision of the School, he can take legal recourse in accordance with law. The writ petition is disposed off as not pressed with liberty as prayed for.

Dasti.
