% 21.01.2020 CRL.M.A. 1220/2020 1.
Allowed, subject to all just exceptions.
BAIL APPLN. 152/2020 2.
The petitioner has filed the present petition, inter alia, seeking bail in connection with FIR No.0364/2018 under Section 302 of the IPC registered with PS Baba Haridas Nagar, Dwarka, Delhi.
3.
It is alleged that the petitioner has murdered his wife. According to the prosecution, the petitioner had also confessed to his mother about murdering his wife. However, the mother of the petitioner has resiled from her earlier statement made to this effect.
4.
Ms Chauhan, learned APP states that there are several other material witnesses that are to be examined. She states that the evidence in this case
would largely be circumstantial. However, there are various relatives of the petitioner who are to testify regarding the circumstances in the said case and it is important that the said witnesses not be influenced in any manner. 5.
It is also pointed out that immediately after the incident, the petitioner had absconded and was not available. He also did not attend the cremation of his wife.
6.
Considering the facts of the case and considering that several witnesses are yet to be examined, this Court does not consider it apposite to accede to the petitioner's this request at this stage. There is not only the risk of the petitioner influencing the witnesses but he also poses a flight risk. 7.
The petition is, accordingly, dismissed.
