This writ petition makes a complaint that tenders issued by the Inland Waterways Authority of India regarding dredging of silt and the cleaning of river Ganga in the Gazipur-Varanasi Stretch in NW-1 in 2014 to M/s Chinar Shipping & Infrasturcture (India) Private Limited, Mumbai, inter alia, on the allegation that award of tender was not in compliance of the CVC Guidelines as well as the terms and conditions stipulated inviting tenders.

Admittedly, the concerned authority, i.e., respondent No.2 is located at NOIDA and the entire action regarding the contract had taken place in the State of Uttar Pradesh. This Court, therefore, does not have the territorial jurisdiction to adjudicate upon the subject matter of the present writ petition.

The petitioner claims to be a practicing lawyer in the State of Madhya Pradesh would be fully aware of the legal position , specially about the requirement of filing the petition in the Court of competent jurisdiction.

Mr.Shivam Sharma, learned counsel appearing for the petitioner, submits that he has instructions to withdraw the writ petition.

The petitioner cannot be compelled to maintain the writ petition. However, in the instant case, the respondents have appeared on advance notice and are entitled to costs.

The writ petition is, therefore, dismissed as withdrawn with costs which are quantified at Rs.5000/- per respondents. The costs shall be paid within two weeks from today.
