% 04.03.2024 I.A. 5178/2024 (u/O XXIII R 3 CPC) & CS(OS) 104/2021 The present application has been filed on behalf of the plaintiff under Order XXIII Rule 3 of CPC seeking a compromise of the suit and passing a decree in accordance with the settlement.

Learned counsels for both the parties submit that the parties have reached an out-of-court settlement. The settlement agreement dated 19.02.2024 has been placed on record. Learned counsel submits that it is a family settlement by which the entire dispute between the parties and their families has been settled.

The perusal of the agreement indicates that it is a detailed agreement that contains several terms and conditions. also submit that the original settlement agreement may be allowed to be deposited with the court.

The settlement agreement is taken on record.

In view of the settlement between the parties, the suit is disposed of being compromised. The pending application also stands disposed of. The suit is decreed accordingly.

Let the Decree sheet be drawn in terms of the settlement between the parties. The acknowledgment letter dated 19.02.2024 has also been placed on record. The original agreement along with the acknowledgement letter dated 19.02.2024 be deposited with the Registry. The next date fixed i.e. 23.04.2024 stands cancelled. The court fee be refunded as per rules.
