O R D E R

The present application is filed by the applicant seeking pre-arrest bail in FIR No. 81/2024 dated 07.04.2024, registered at police station New Friends Colony for the offences under Sections 33/52 of the Delhi Excise Act, 2009. 2.

The status report is filed by the State and the same is taken on record.

It is alleged that on 07.04.2024, a secret information was received alleging that a large quantity of illicit liquor will be brought to New Friends Colony.

The police thereafter reached the designated spot and pursuant thereto, a car was confiscated and on search was found to be carrying 30 carts of illicit country made liquor. 5.

It is alleged that the car was being driven by co-accused Naresh and is owned by co-accused Ramesh.

disclosure statement stated that the alleged confiscated liquor was to be delivered at the premises belonging to the applicant. 7.

In the present case, the applicant is sought to be implicated on the basis of the disclosure statement of co-accused Naresh who deposed that the alleged confiscated liquor was to be unloaded in the premises of the applicant.

This Court by order dated 25.02.2025 noted that both the co-accused persons Naresh and Ramesh have already been admitted on bail and thereby directed the State not to arrest the applicant on him joining the investigation till the next date of hearing.

It is not disputed that the applicant has since joined the investigation and the evidence at this stage against the applicant is only the disclosure statement of the co-accused, which in the absence of any corroborative material may not be admissible evidence.

On being asked, the Investigating Officer also informs that the premises of the applicant had been searched and nothing incriminating was found there.

In view of the above, it is directed that in the event of arrest, the applicant shall be released on bail on furnishing a personal bond for a sum of ₹20,000/- with two sureties of the like amount, subject to the satisfaction of the concerned SHO, on the following conditions:

a. The applicant shall not leave the country without the prior permission of the learned Trial Court; b. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

with the evidence of the case, in any manner whatsoever;

c. The applicant shall appear before the learned Trial Court as and when directed;

d. The applicant shall provide the addresses where he would be residing after his release and shall not change the addresses without informing the concerned IO/SHO;

e. The applicant shall give his mobile numbers to the concerned IO/SHO and shall keep their mobile phones switched on at all times.

In the event of there being any violation of the stipulated conditions, it would be open to the State to seek redressal by filing application seeking cancellation of the bail. 13.

It is clarified that the observations made in the present order are for the purpose of deciding the present anticipatory bail application, and should not influence the outcome of the Trial and should not be taken, as an expression of opinion, on the merits of the case.

The present bail application is allowed in the aforesaid terms.
