This Petition under Section 29A of the Arbitration and Conciliation Act, 1996 has been filed by the Petitioner for extending the mandate of the Arbitral Tribunal.

Material on record indicates that the Petitioner invoked arbitration vide a notice dated 10.12.2021 and appointed its nominee Arbitrator. The Respondents replied to the said notice by appointing their nominee Arbitrator. Both the nominee Arbitrators being the former Judges of this Court, nominated the Presiding Arbitrator, thereby, the Arbitral Tribunal was constituted. pleadings got over on 25.05.2023. It is stated that the parties had extended the mandate of the Arbitral Tribunal by mutual consent for a period of six months. It is stated that the Petitioner, thereafter, filed a petition for extension of the mandate before this Court and this Court vide Order dated 04.03.2024 extended the mandate of the Arbitral Tribunal till 28.02.2025. The mandate of the Arbitral Award is going to expire on 28.02.2025. 3.

It is stated that final arguments are going on and further dates of hearing has been fixed on 01.03.2025, 07.03.2025 and 21.03.2025. 4.

Learned Counsel appearing for the Respondents states that he has no objection if the mandate of the Arbitral Tribunal is extended 5.

In view of the facts of the present case, this Court is inclined to extend the mandate of the Arbitral Tribunal till 31.12.2025, so that the award can be pronounced.

The Petition is disposed of, along with the pending applications, if any.
