It is the anxiety of the learned Counsel for the Petitioner that the findings given in the Order dated 11.09.2024 regarding the existence of the Purchase Order including its terms is a final expression on the merits of the case or not.

It is clarified that the observations made in the Order dated 11.09.2024 is only in the context of a petition filed under Section 16 of the Arbitration and Conciliation Act, 1996 and obviously would be considered by the Arbitrator depending on the evidence being led by the parties. 3.

With these observations, the instant petition is disposed of. 4.
