The present petition is listed for 02.09.2025. 2.

However, in the interregnum, the abovesaid application was moved seeking advancement of the date and final disposal of the main petition. 3.

The Petitioner herein is plaintiff before the learned Trial Court and is aggrieved by order dated 20.04.2023 whereby the learned Trial Court has dismissed his application moved under Order XVI Rule 1 CPC whereby petitioner wanted to examine one witness.

Learned counsel for petitioner, however, submits that the matter was taken up by learned Trial Court on 17.05.2025 and the suit, as such, has been disposed of.

In view of the above, learned counsel for petitioner submits that the present petition has become infructuous.

He submits that final order has yet not been uploaded on the website and, in case, the petitioner is compelled to challenge the final judgment or decree, in that scenario, he would also challenge the order which is impugned herein.
