After some hearing, the counsel for the petitioner submitted that the case against him arising out of FIR No. 279/2018 under Sections 376/506/509/34 IPC of police station Amar Colony has already been committed to the court of Sessions by the Metropolitan Magistrate by his subsequent order and that the case is now at the stage of consideration of charge before the court of Sessions in which view he seeks permission to withdraw the present petition praying for liberty to move the said Court by an application under Section 91 Cr.P.C. for summoning such of the documents as were not made part of the charge-sheet but are in the custody and control of the investigating officer, some of them having even been referred to in the FIR.

CRL.M.C. 591/2019

The petition is dismissed as withdrawn with liberty as prayed, granted. Accompanying applications are also disposed of as infructuous. Dasti under the signatures of Court Master.
