O R D E R

The present bail application has been filed under Section 439 read with Section 482 Cr.P.C. seeking interim bail in FIR No. 47/2015 under Sections 21/29 NDPS Act registered at Police Station Special Cell, Delhi. 2.

Learned counsel for the petitioner submits that petitioner's father Aftab Khan is seriously ill and suffering from spinal cord space occupying lesion (intramedvoary) paraplegia. He submits that the patient was advised for surgery, however on account of his old age and other complications the attendant of the patient denied the same.

Learned counsel for the petitioner further submits that the petitioner was earlier also released on interim bail and he has not misused the concession of bail granted to him.

Learned APP for the State has handed over a copy of the Status Report which is taken on record. It is stated that the medical papers of the BAIL APPLN. 172/2020

petitioner's father have been verified from Safdarjung Hospital and the petitioner's father was examined in the hospital by the concerned Doctor on 17.01.2020.

In view of the facts and circumstances of the case, the petitioner is admitted to the interim bail for a period of seven days from the date of his release, on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of Jail Superintendent, subject to the following further conditions :- (i) The petitioner will report to the concerned SHO/IO, PS Special Cell, Delhi every alternate day at 10.00 A.M. (ii) The petitioner shall provide the I.O./SHO, P.S. Special Cell, Delhi with his mobile telephone number, which he undertakes to keep operational during the period of his release. (iii) The petitioner will not directly or indirectly make any inducement, threat or promises to the complainant or any witness during this period or tamper with the evidence. (iv) The petitioner shall not leave the jurisdiction of the National Capital Territory of Delhi.

(v) The petitioner will surrender before the concerned Jail Superintendent, at the expiry of the release period. 6.

With the above directions, the bail application is disposed of. 7.
