Heard learned counsel for the parties.

After arguing at some length, the learned Senior Counsel for the appellant prays that he may be permitted to be withdrawn. 3.
He has also stated that the appeal against the order passed by the National Company Law Tribunal is pending consideration before the National Company Law Appellate Tribunal (hereinafter referred to as 'NCLAT') and accordingly, a direction be issued to the NCLAT to dispose of the appeal within some specified period.

So far as the first prayer is concerned, learned counsel representing the respondents does not have any objection, accordingly, this appeal is dismissed as withdrawn.

However, as far as the prayer regarding the issuance of direction to NCLAT is concerned, we may note that NCLAT is not a party in this proceeding.

However, in the interest of justice, we permit the appellant to make such a prayer before NCLAT itself which may be considered in accordance with law.
