O R D E R

By way of the present application, the applicant seeks grant of interim bail for a period of four weeks, in case arising out of FIR bearing No. 201/2023, registered at Police Station Samaipur Badli, Delhi, for the commission of offence punishable under Sections 376 of the Indian Penal Code, 1860 (hereafter 'IPC') and Sections 6 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act') to enable him to appear in the examination scheduled to be held from 13.03.2026 to 01.04.2026.

This Court notes that the factum of examination was verified by the Prosecution when the matter was taken up by the learned Trial Court on 10.03.2026. The learned Trial Court, however, vide order dated 10.03.2026 has dismissed the application for grant of interim bail on the ground that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

since the applicant was granted interim bail on 04.08.2023, he had not surrendered in time and NBWs had to be issued against him. However, later on, he had surrendered on 12.01.2024.

Considering the overall facts and circumstances of the present case, and the fact that the victim in this case has already been examined on 16.04.2024, the applicant is in judicial custody for last 03 (three) years, the applicant is only 23 years of age and he has to appear for his B.A. examination, this Court is inclined to grant interim bail to the applicant for a period of 03 weeks from the date of his release, subject to following conditions:

i) The applicant shall furnish a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the concerned Jail Superintendent. ii) The applicant shall surrender his passport, and will not leave the country during this period.

iii) The applicant shall also provide his mobile number to the Jail Superintendent, as well as I.O./S.H.O. concerned, which shall be kept operational at all times. iv) The applicant shall not indulge in any criminal activity during the period of interim bail.

Accordingly, the present interim bail application stands disposed of. 5.

A copy of this order be directly sent to the concerned Jail Superintendent for information, by the Registry today itself. 6.
