Having heard the learned counsels for the parties present and upon a perusal of the record, the position that emerges is that this Court vide order dated 20.01.2025 in W.P.(C) No. 704/2025 recorded the undertaking of the learned counsel for the respondents to the effect that the process of handing over/taking over of the works carried out by the petitioner would commence as expeditiously as possible, and would be completed within a period of four weeks from today. It is evident that the petitioner has been the contractor responsible for refurbishing the premises in question, which is intended to be operated as a hospital and belongs to the respondents. 5.

The grievance of learned counsel for the petitioner is that, despite the undertaking given on 20.01.2025, the process of handing over/taking over has not been fully completed. 6.

Mr. Kiranbabu Konru/respondent No. 1, who is the Executive Engineer (Electrical), is present and submits that the process of handing over/taking over has already commenced with regard to the fourth, fifth and sixth floors of the building, which having been taken over. He further states that the remaining floors viz the first, second and third floors will be taken over within the two weeks from now. 7.

Let the process of handing over/taking over be completed within a period of three weeks from today. In the event of noncompliance, the concerned Secretary shall appear in person before this Court to explain the reasons for the undue delay in the handing over/taking process, which is consequently delaying the provision of essential health services to the people. The handing over/taking over exercise be completed without prejudice to any legal that may be contemplated against the petitioner for any deficiency in service. 8.

The petition is disposed of accordingly, with liberty to the petitioner to approach this Court, in case this order is not complied with. Pending applications, if any, stand disposed of.
