% 29.05.2025 [Hearing has been conducted through Video Conferencing] CM APPL. 34630/2025 (Restoration) 1.

Pursuant to previous order dated 29th April 2025, the petition had been disposed of on the basis of the statement made by Mr. Koneru Kiran Babu, Executive Engineer (PWD), stating that the date of taking of the premises, as well as issues which are residual, will be communicated to the petitioner within a period of one week.

It is now stated by Mr. Jeevesh Nagrath, Senior Counsel appearing for the petitioner, that the same has not been done. 3.

Mr. Babu, who was directed to be present, appears and states that while possession of the premises has been taken over, four services, namely, MGPS, MOT, CSSD, and PTS, have not been taken over yet. 4.

The Court is unable to comprehend as to why there is delay in taking over the works, considering that the Court in order dated 20th January 2025, had already stated as under:

Despite this order, and considering that there is consistent delay and omission in taking over the works, without prejudice to the contractual rights which may arise under the contract to the respondent, the Court is, therefore, inclined to issue a Show-Cause Notice to respondent No.5/Chief Engineer, to be present in Court or through VC on the next date of hearing. 7.
