Learned counsel for the petitioner submits that during the pendency of the present petition, a similar grievance as raised by the petitioner, has been decided by the learned Tribunal vide its order dated 16.01.2023 by allowing O.A No. 2869/2018 filed by identically placed applicants. He submits that vide this order of the learned Tribunal, the respondent has been directed to refer the same grievance as raised by the petitioner, to an Expert Committee. He submits that he has instructions to state that the said decision has already been implemented by the respondent and therefore, prays that the present petition be disposed of by directing the respondents to extend the benefits of the said order to the petitioner as well.

very same question qua which the petitioner had raised a grievance, the benefit of the said decision in O.A. 2869/2018 if not assailed, will be extended to all affected candidates including the petitioner. 3.

In the light of the aforesaid stand taken by the learned counsel for the respondent, the present writ petition is disposed of by directing that the impugned order will not come in the way of the respondent extending the benefit of the decision of the learned Tribunal in O.A No. 2869/2018 to the petitioner.
