Parties in this suit for recovery of Rs. 1,42,93,140 were referred to Mediation Cell of this Court.

Mediation has been successful with the efforts of Shri Vishwa Bhushan Arya, Advocate / Mediator and a Settlement Agreement dated 14th September, 2016 purported to be signed on behalf of the plaintiff as well the defendant as well as by the advocate for the plaintiff and the mediator has been received from the Mediation Cell of this Court. The said settlement agreement also has annexed thereto the authorisation in favour of the signatory of the plaintiff and the defendant. 3.

The counsel for the plaintiff and Ms. Parul Sharma, Assistant Manager of the Defendant Vipul Limited appearing in person and as identified by the counsel for the plaintiff, support the Settlement Agreement. CS(COMM) 155/2016

The compromise/settlement arrived at between the parties and as recorded in the Settlement Agreement is found to be lawful and is allowed. 5.

The counsel for the plaintiff states that out of the settled amount a sum of Rs.14,33,877 as well as some other amounts have already been received.

A decree is passed in favour of the plaintiff and against the defendant in terms of the Settlement Agreement which alongwith its annexures shall form part of the decree sheet.

The parties to bear their own costs.

8.

Decree sheet be prepared.

9.
