The petitioners have filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [corresponding to Section 482 of the Code of Criminal Procedure, 1973], seeking quashing of FIR No. 889/2022 dated 03.10.2022, registered at Police Station Dabri, New Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860, and consequential proceedings emanating therefrom, on the ground of settlement.

Although the matrimonial proceedings have apparently been settled and a Joint Agreement Application dated 20.12.2025 was placed on record before the concerned Family Court, Farrukhabad, Mr. Abhishek Kumar, learned counsel for the petitioners, states that divorce proceedings between petitioner No. 1 and respondent No. 2 remain pending.
