MAT.APP.(F.C.) 33/2019 & CM APPL. 5181/2019 (stay) The right to lead evidence of the respondent (appellant herein) was closed on 23.01.2019 which has led to the filing of the present appeal. Counsel for the appellant submits that evidence of the petitioner (respondent herein) was closed on 06.12.2018 and thereafter, the matter was adjourned for recording of evidence of the respondent (appellant herein) on 23.01.2019. He submits that no adjournment was sought by the appellant prior to this date.

Issue notice to show cause as to why the appeal be not admitted. Notice in the application as well.

We are informed that the date fixed before the Family court is 06.02.2018.

Counsel for the appellant submits that evidence by way of affidavit is ready and he will file the same on 06.02.2019, when the matter is listed. Counsel for the appellant will inform the learned counsel for the respondent about this order in addition to service dasti. List on 12.02.2019.
