Mr. Sabharwal, learned counsel for MCD submits that contrary to the allegations of the Petitioner, no CCTV cameras are presently installed in the property bearing No. C-42, third floor, East of Kailash, New Delhi ('subject property'). A complaint was received three months ago from the Petitioner regarding installation of the CCTV cameras and accordingly, action was taken and the CCTV cameras were directed to be removed. The stand of MCD is taken on record.

Insofar as the unauthorised construction is concerned, it is stated that the property was booked on 28.01.2025 and the owner/occupier of subject property had requested for a personal hearing. granted within a period of one week from today, depending upon the stand taken by the owner/occupier of subject property, further action will be taken by MCD.

Accordingly, at this stage, no further orders are required to be passed in the writ petition. It is made clear that any action by MCD will be after hearing the owner/occupier of subject property and compliant with applicable statutory provisions and keeping in view guidelines laid down by the Supreme Court in In Re: Directions in the matter of demolition of structures, 2024 SCC OnLine SC 3291.

This order is passed without prejudice to the rights and contentions of the owner/occupier of the subject property.

In case of any surviving grievance, Petitioner will be at liberty to take recourse to legal remedies.

Writ petition stands disposed of.
