O R D E R
% 04.02.2019 CM No.5196/2019 1.
Allowed, subject to all just exceptions.
W.P.(C) 1147/2019 & CM No.5195/2019 2.
The petitioner has filed the present petition, inter alia, praying that the impugned order dated 04.01.2019 passed by respondent no.1 (Delhi Medical Council - DMC), whereby the petitioner has been imposed with a penalty directing removal of her name from the State Medical Register for a period of ninety days. In addition, the petitioner has been directed to undergo 12 hours of Continuing Medical Education (CME) on the subject of 'Labour Management' and submit a compliance report to the DMC. 3.
The petitioner has filed an appeal against the said order before the Medical Council of India (MCI), which is pending. 4.
The learned counsel appearing for the petitioner states that the
petitioner's appeal would be frustrated if the impugned order directing removal of her name from the State Medical Register is implemented. It is also contended that the said appeal is unlikely to be heard shortly. 5.
The aforesaid grievance is justified. Without going into the question of merits of the petitioner's appeal, this Court is of the view that, it would be apposite to stay the direction for removal of the petitioner's name from the State Medical Register till the petitioner's appeal is heard and decided. It is so directed.
6.
It is clarified that the direction that the petitioner undergoes twelve hours of CME on labour management is not stayed, and the petitioner will comply with the same.
7.
The petition is disposed of in the aforesaid terms. 8.
