% 04.02.2019 At the outset, Mr. Rajesh Mahajan, the learned counsel for the State submits upon instructions, that happily the petitioner's daughter, who is just over 16 years of age, has been brought back to Delhi by the police. The petitioner-mother and her daughter are present in the Court. Since the daughter does not have a counsel, Ms. Geetanjali Tiwari, Advocate, present in the Court, is appointed as her counsel for the day. She states upon instructions that the minor wishes to resume her habitation with her mother, much to the petitioner's relief. The Court had interacted with the minor in Chambers in the presence of her counsel, Ms. Nandita Rao and Mr. Rajesh Mahajan, the learned
counsel for the State. She has reiterated her desire to live with her mother. In the circumstances, let her resume her residence with her mother. She shall be released to her mother.
However, looking at the nature of allegations made in the petition, the Court is of the view that the Child Welfare Committee of the area shall interact with the mother and the daughter once a week, at least for the next four weeks and thereafter at such intervals as they may seem appropriate. Additionally, the petitioner and the minor daughter shall be provided with telephone numbers of three police officers from the jurisdiction of the Police Station where they reside, of which two numbers shall be of lady police officers, so that the parties could contact them in case of any exigency. Mr. Mahajan assures the Court that any intimation to CAW Cell or to the local police either by call or through SMS/Whatsapp shall be immediately responded to. The police shall otherwise ensure the safety and security of the petitioner and her minor daughter. The petition stands disposed-off accordingly.
