Application under Order XLI Rule 5 of the Code of Civil Procedure, 1908 (hereinafter referred to as the "CPC") has been filed on behalf of the Appellant wherein it is submitted that the claim of the Appellant for the salary due from September, 2015 till March, 2017 has been denied only because the Appellant had not placed on record his own bank statement to show that no salary was credited to his account. 2.
The copies of the bank statement has now been filed. 3.
Considering the circumstances and that there are additional documents to be proved on behalf of the Appellant, the impugned ex parte judgment dated 23.11.2022 is hereby set aside and the case is remanded back for adducing additional evidence and for deciding the suit afresh. 4.
